Rambeau, LLC (“RAMBEAU,” “we,” “our,” or “us”) takes your privacy seriously. Please read the following to learn more about our Privacy Policy. This policy covers how we treat the information that we collect and receive. By accessing and using our website https://Mrparadise.net, web properties (e.g., widgets and applications), mobile applications (“Mobile Apps”) or our webstore accessed through our website, web properties, and/or Mobile Apps (each, a “Property” or collectively the “Properties”), you agree to these terms and conditions of our Privacy Policy.  Access and/or use of any of the Properties is referred herein as the “Service.”  We may update this Privacy Policy from time to time as our services change and expand. We will notify you of such changes by posting them through the Properties.  Our company, RAMBEAU, is located in the United States and the Properties are based in the United States.  By using any of the Properties, you agree to the transfer of your personal information to or within the United States.



Personal Information Collected


RAMBEAU collects personal information (information from and about you which identifies you as an individual) when you register with any of our Properties and when you view, use or purchase products or services through any of our Properties. When you contact us through any of the Properties or create a member account, we may ask for information such as your name and last name, a physical street address, an email address, your telephone number, and, if you make a purchase through any of our Properties, your credit card number and related information. RAMBEAU may also collect personal information about you offline, for example, if you provide information tous while participating in promotions sponsored by us.  RAMBEAUmay also receive personal information about you from other sources, including, databases that are available to the public, or from marketing partners.

 

If you rely on social media or other third-party account to participate in contests or promotions, you will share certain personal information from such third-party account with RAMBEAU which may includephotos, social media contacts, playlist history, preferences, and any other information that you make available or which is otherwise accessible to RAMBEAU when you access the third-party account.


RAMBEAU and its third-party service providers may use the information we collect from and about you for any of the following purposes: (1) to fulfill your requests for products and services, if applicable; (2) to provide you with targeted offers and advertising; (3) to contact you, including contact through text messages; (4) to review usage and operations of the Properties, improve the operation of the Properties, and to accomplish our business purposes; (5) to address problems with any of our Properties, our business or our products and services; (6) to protect the security or integrity of our Properties and our business; (7) to provide functionality such as providing you with customer service or responding to your requests; (8) to enable transmission of your messages to friends through use of the Properties (by using such functionality you are letting us know that you are permitted to use and provide us with your friend’s name and email address); (9) to analyze and predict your preferences and to personalize your experience while using the Properties; (10) to allow you to participate in contests or similar promotions; and (11) to aggregate or anonymize information about you (which is no longer considered personal information).

Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser. Like many websites, RAMBEAU uses cookies to collect anonymous visitor information, such as IP address, browser type, the time and length of your visit, and the pages you visit. This information may be used in order to: (1) remember the products in your shopping cart, if applicable; (2) recognize you when you return to the site; (3) improve and personalize your experience on our site; (4) provide you with customized advertising; and (5) monitor usage of the Properties and analyze the behavior of site visitors. We may combine Non-Personal Information with your personal information, and if we do, we will treat the combined information as personal information as long as the information remains combined

How long will cookies stay on my device?

The length of time a cookie will stay on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Session cookies will only stay on your device until you stop browsing. Persistent cookies stay on your computer or mobile device until they expire or are deleted.

 

First and third party cookies

First-party cookies are cookies that belong to us, third-party cookies are cookies that another party places on your device through our Service. Third-party cookies may be placed on your device by someone providing a service for us, for example to help us understand how our service is being used. Such companies may be: (1) our service providers, suppliers and business associates, if the disclosure will enable them to fulfill your request for products or services from us for another vendor on our site or any other Property; (2) to our service providers and business associates, if the disclosure will enable them to perform a business, professional or technical support function for us; (3) to our affiliates and other third parties so that they may contact you with marketing offers of their own; (4) to credit bureaus or government agencies in connection with issues related to fraud, credit or debt collection; (5) as necessary if we believe that there has been a violation of our site Terms of Use, of the law or of our rights or the rights of any third party.


Under the following circumstances, we may still be required to share your personal information:

• If we transfer information about you in the event that RAMBEAU is acquired by, reorganized or merged with another company.

 

We may also disclose the information we collect from and about you to: (1) our affiliates; (2) third-party providers of services such as web hosting, order fulfillment, credit card processing, and other services; (3) third parties in order to enable them to send you marketing communications; and (4) third parties that sponsor contests or similar promotions.

 

Our Properties may be configured to allow you to post personal information or content, and in the event that you do, any personal information or content that you voluntarily upload or submit for posting to through the Properties becomes publicly available and can be collected and used by others. It is in violation of the site’s Terms of Use for you to post any content that requests personally identifiable information.


Information Sharing and Marketing

 We understand and respect that not all customers or visitors may want to allow us to share information with other select companies or to use the information we collect about you to send you information about our productsand services. If you do not want RAMBEAU to share your customer information or to contact you for marketing purposes, please immediately email us at Rambeaullc@gmail.comand we will remove your name from lists we share with other companies and from lists that we use to contact persons for marketing purposes. Please note that this request may take up to six to eight weeks to be effective. When contacting us, please clearly state your request, including your name, mailing address, email address and phone number.


Data Protection Rights Under the GDPR

Under applicable data protection laws such as the European Union’s General Data Protection Regulation, users may be entitled to the following:


The right to access - You may have the right to request RAMBEAUfor copies of your personal data. We may charge you a fee for this service.


The right to rectification - You may have the right to request that RAMBEAUcorrect any information you believe is inaccurate. You may also have the right to request RAMBEAUto complete information you believe is incomplete.


The right to erasure - You may have the right to request that RAMBEAUerase your personal data, under certain conditions.


The right to restrict processing - You may have the right to request that RAMBEAUrestrict the processing of your personal data, under certain conditions.


The right to object to processing - You may have the right to object to RAMBEAU’sprocessing of your personal data, under certain conditions.


The right to data portability - You may have the right to request that RAMBEAU transfer the data that we have collected to another organization, or directly to you, under certain conditions.

Your California Privacy Rights

 

If you are a California resident, you may request certain information once per year about our disclosure of certain categories of Personal Information during the preceding calendar year to third parties for such third parties’ own direct marketing purposes. Rambeau Children's Privacy Policy

Rambeau does not knowingly permit children who are less than 13 years of age (“Child Users”) to register directly for our Service without consent of a Parent or School. If Rambeau learns that personal information of a Child User has been collected through use of the Properties without parental consent, then Rambeau will take appropriate steps to delete this information. If you are a parent or guardian (“Parent”) and discover that your child under the age of 13 has a registered account with our Service without your consent, please alert Rambeau at _Rambeaullc@gmail.com___________ and request that we delete that child’s personal information from our systems.

Child Users can sign up for a Rambeau account in several ways

1.When a Child User signs up for a Rambeau Account we request Parental consent.

When a Child User registers for use of the Properties, we request a birthdate, username, password, and a parent's email address so that we can email the Child User's Parent in order to seek consent for the Child to use the Properties. Rambeau does not ask the Child User for any more information than is necessary to provide the access to the Properties to the Child User or to seek parental consent. The Child User is permitted to access and use the Properties for seven (7) days through a Restricted Account (see below) while we notify the Parent for consent. If we do not receive Parental consent within 7 days, the Child User's Restricted Account is closed, and the Child's personal information is deleted from our systems.

2. When a Child User account is created by a School, the School may provide consent.

When the Rambeau Service is used by a teacher, school, or district (a “School”) in the classroom for an educational purpose, we permit the School to create Child User accounts and to provide the requisite consent for Rambeau to collect personal information of a Child User for this purpose, in lieu of parental consent. Schools may create a Child User account by adding students to the Service through Google Classroom, Clever, or similar single sign-on service, or through a school integration mechanism, or a School may create logins/passwords for each individual student. When Schools create accounts in this manner, we do not request additional consent from the Parent. However, when a School or other individual invites a Child User to join the Service and connect to a teacher or coach's class using a class code, we request parental consent in the manner described below.

Methods for providing Parental consent

Parents may provide consent for a Child User to use the Service through a Restricted Account (explained below) by responding affirmatively to an email sent by Rambeau to the Parent's email address provided by the Child User during registration. If we do not receive consent from the Parent within seven (7) days, the Child User's account will be closed and the Child's personal information is deleted from our systems. Restricted Accounts may access and use certain features of the Service in a limited manner.

To enable additional functionality for the Child User account and to enable full access and control over the Child User's account activity, the Parent must create a Parent Account on the Service and connect to the Child User's account by clicking on the account creation link in the Parental consent notice. Parent Accounts control the settings and functionality of the Child account. The Parent can maintain the Child's Restricted Account, and/or can enable additional functionality and data sharing features, if desired. Parents can revoke a Child User's permissions to use the Service at any time by deleting the account.

Restricted Accounts for Child Users

Rambeau attempts to restrict a Child User's access to certain features that could result in disclosure of the Child's personal information. A Restricted Account limits sharing and displaying private information about the Child User in various ways.

For example, a Child User with a Restricted Account cannot:

-        display personal information other than a username. Restricted Accounts contain the Child's username and do not include other personal information or profile data. Because the username may be displayed on the Service, we strongly recommend selecting a username which does not relate to or identify the real name of the Child. The Child username can be selected or revised by the Parent by creating a Parent Account.

-        add or edit personal information associated with a Restricted Account

-        post to public discussion forums, or post questions or answers on lessons

-        see or access links to third-party sites on the Service

-        receive emails from Rambeau (all emails are sent to the Parent email on file)

A Parent who creates a Parent Account can manage and control additional features and functionality. For example, Parents can create or revise a Child's username and add or revise profile information.


What information do we collect from a Child User?

We collect a username, birthdate, and Parent's email address when a Child User registers for the Service, as well as any other personal information a Parent adds to a Child User's account, as described above. We collect information about the Child User's use of the Service (rewards earned, participation in contests) as well as content the Child posts to the Service if such functionality is enabled by the Parent. We also collect usage and device information, as described in the Privacy Policy. We use this information to provide the Service to the Child User and for the purposes described in our Privacy Policy's section “Personal Information Collected.” We use the Parent's email address to communicate messages about the account.


How do we disclose information relating to a Child User?

As described above, Restricted Accounts have limited data sharing capabilities. A username and progress information, along with any personal information the Parent added to the Child's profile, is shared with a teacher added to the Child User's account. Parents may also enable additional data sharing features through a Parent Account, for example, by adding profile information and permitting the profile to be shared with other users, or enabling the Child User to post content (e.g., questions and answers) to the Service. Parents that enable content-posting features should be aware that a Child User could post personally identifiable information in free-form content on the Service, and should monitor the Child User's posts and delete personal information if needed. We may also disclose personal information of Child Users for business purposes, as described in other sections of our Privacy Policy.


Third party tracking and online advertising

Rambeau does not display any targeted advertising on the Service[JS1] . We do not disclose personal information of Child Users for direct marketing purposes or for targeted advertising purposes. While we do permit third party advertising partners to operate on our Service for the purpose of retargeting, analytics and attribution services, we take steps to disable third party ad networks on webpages with child-directed content or when a Child User logs into a Restricted Account on the Service.

 

How to access, modify and delete your Child's personal information

As a Parent, you have the ability to access control [JS1] information about your Child User in the “Your Children” section of your Parent Account. To refuse future collection or use of your child's Personal Information, you can delete your Child User's Account. Please note, you must delete your Child User’s account before you delete the Parent Account.

Security and Retention Period


Unless indicated otherwise at the time of the collection of your personal data (e.g. within a form completed by you), we erase your personal data if the retention of that personal data is no longer necessary (i) for the purposes for which they were collected or otherwise processed, or (ii) to comply with legal obligations (such as retention obligations under tax or commercial laws).


Third Party Websites

The site may contain links to third-party websites, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these sites. 


The inclusion of a link to a third-party website on any Property should not imply that RAMBEAU endorses or is affiliated with the linked site by us or by our artists or affiliates. The Properties may enable access and submission of certain information directly to third parties, such as Instagram, or to an external application platform (for example, Google Play). Such information is submitted by you directly to such third parties and this Privacy Policy does not apply to any such information submitted by you.  Accordingly, we recommend that you review the privacy policy posted on any site that you may access through our site.
